requirements for family member of EU citizen

Who is a family member of an EU citizen?

A family member of an EU citizen is a family member of a citizen of any of the EU country or Iceland, Lichtenstein, Norway and Switzerland, who is a:

- spouse,
- parent if it concerns someone who supports an EU citizen under 21 with whom they live in a common household,
- child under 21 or such a child of the spouse of an EU citizen and
- dependent direct relative in an ascending or descending line or such a relative of the spouse of an EU citizen.

A dependent person is understood to be a third-country national supported by a EU citizen or the spouse thereof who:

- is systematically preparing for a future profession up 26 years of age;
- cannot systematically prepare for a future profession or perform gainful activities due to illness or injury; or
- is not capable of performing systematic gainful activities due to a chronic adverse health condition.

A family member of an EU citizen can also be understood to be a foreign national who can credibly prove that:

a) they are a relative of an EU citizen that is not specified above if:

- they lived in a common household with an EU citizen in the country whose citizenship they hold or in the country in which they held long-term or permanent  residence;
- they are supported by an EU citizen; or
- they cannot care for themselves without the personal care provided by an  EU citizen due to a chronic adverse health condition; or

b) they are in a permanent relationship with an EU citizen that is comparable to a family relationship and that they share a common household.


Requirements

  1. Visa application form (form Schengen EN 2020 (PDF, 220 KB))
    - Fill in the form completely and legibly. Do not complete fields no. 21, 22, 30, 31 and 32. Use the European date format "dd. mm. yyyy".
    - Fields no. 1-5: Your personal data (surname, first name, place of birth, etc.) on the form must be identical with the data recorded in the valid passport, and must match your personal data in the documents specified below.
    - Field no. 25: Include all Schengen countries that you intend to visit on the upcoming trip.
    - Field no. 27: Leave blank if in doubt.
    - Remember to sign the form on the last page. Add the place where and the date when you signed the form in the box to the left of your signature.
     
  2. One recent color passport size photograph (3.5 x 4.5 cm or 2 x 2 inch).
    - White background, entire face must be clearly visible.
    - No sunglasses. No headgear, except when worn for religious reasons.
    - Good print quality on high quality photo paper, made at professional photo studio.
    - Glue the photograph over the correspondent space on the form (upper right corner of the first page).
     
  3. Valid passport.
    - Expiration date must be at least one day after the date of arrival into the Czech Republic.
    - Must contain at least one blank "Visa" page.
  4. One copy of the passport data/photo page.

  5. Documents proving your legal status in the US and other visas.
    - Valid Alien Registration Card (Green Card) OR valid US visa (type A, E, F /plus endorsed I-20, F-1, DS-2019 or IAP-66/, G, H, I, J /plus J1 document/, L, O, R) AND your I-94 Arrival/Departure Record.
    - US residence permit or visa must be valid for at least 3 months after the last intended date of departure from the Schengen Area.
    - Proof (visa, passport) that you can legally enter the next country on your trip after you visit the Schengen Area.
    - Applicants who, after visiting the Schengen Area, travel to another country requiring a visa must have this country's valid visa issued in their passport before applying for Schengen visa. Provide one copy of this visa when submitting your Schengen visa application.
     
  6. One copy of the valid Green Card OR valid US visa (with any endorsed forms).
     
  7. Documentation confirming your status of a family member of EU citizen:
    - Original or notarized copy of a Czech marriage certificate (in case of spouse) or a Czech birth certificate (in the case of child), OR
    - Original of a marriage certificate (in case of spouse) or birth certificate (in case of child) issued by an EU country, or a notarized copy thereof, together with the standard multilingual form (in all EU languages), or with a certified translation into Czech (made in any EU country), OR
    - Original or notarized copy of the respective third country marriage certificate (in case of spouse) or birth certificate (in case of child), certified by Apostille (or via superlegalization where appropriate), together with a certified translation into Czech (made by an interpreter appointed by Czech court).
     
  8. One copy of the passport data/photo page of the the EU citizen.
    - Onto the photocopy, the EU citizen shall add a hand-written declaration "I agree to the copy made." OR "Souhlasím s pořízením kopie svého cestovního pasu.". Further, the EU citizen shall affix his/her signature, and the location where & date ("d. m. yyyy" format) when the declaration and signature were done. If the EU citizen is not present at the Consulate General, the signature on the photocopy shall be notarized (e.g. by a US or Czech notary public or by a Czech Honorary Consul).
     
  9. Document(s) proving that the visa applicant either accompanies or follows the related EU citizen to the Czech Republic, such as "shared" air tickets or hotel reservations
     
  10. Visa fee is zero.
     
  11. Trackable prepaid self-addressed USPS envelope or prepaid self-addressed UPS envelope:
    - Only if the applicant needs the passport to be mailed back and cannot pick up the passport personally at the Consulate.
    - Envelopes from FedEx or other mailing companies are not accepted.
    - Insert your own name and address both in the "From:" and "To:" box on the shipping label.
    - Note the tracking number for your reference before handing in the envelope to the visa officer.
    - For USPS envelopes, affix the appropriate postage in stamps.
    - The Consulate cannot be held responsible for any delays or losses in the mailing of the envelope; the applicant must contact the mailing company directly.
     
  12. One photocopy of the front side of the envelope, if provided under no. 11, with the completed shipping label, prepaid postage and tracking number clearly visible.

Additional documents may be required by the visa officer.
All additional documents requested to be emailed to the Consulate must be in PDF format only.
Submission of the documents mentioned above does not guarantee that a visa is granted.
