The Register of Damage for Ukraine has launched a new category of claims: Loss of individual enterprise (A3.5)

The Register of Damage for Ukraine has officially launched a new category of claims for compensation for damage caused by the aggression of the Russian Federation against Ukraine – Category A3.5: Loss of individual enterprise.
This category is designed for individual entrepreneurs who suffered a loss of profits from their entrepreneurial activities in Ukraine on or after 24 February 2022 due to the internationally wrongful acts of the Russian Federation.
Claims in this category may be submitted by individuals who are registered as individual entrepreneurs and have lost profits from their individual enterprise as a consequence of the aggression of the Russian Federation against Ukraine.
To submit a claim in this category, individuals need to provide evidence about their entrepreneurial activity, events that caused the loss of such activity, as well as financial records to corroborate the amount of profits lost because of that. Financial reporting submitted to the tax authorities in Ukraine will be made digitally available to the individual entrepreneur as part of the claim’s submission process.
Claims with respect to any assets owned by the individual that were destroyed, damaged or lost due to the war shall be submitted in other relevant categories A. Claims by or on behalf of legal entities shall be submitted in other relevant categories B or C that are expected to be launched soon.
The launch of Category A3.5 is a further step in recording and recognizing the damage, loss and injury suffered by Ukrainians as a result of the aggression of the Russian Federation.
Claims that meet the eligibility requirements will be recorded in the Register and subsequently transmitted to the future Claims Commission, which will determine the amount of compensation due. In December 2025, 35 States and the European Union signed the Convention on the Establishment of an International Claims Commission under the auspices of the Council of Europe.
