Birth certificate

How to proceed if you only have an Australian birth certificate for your child and you intend to apply for a Czech birth registration and a Czech birth certificate.

The most important supporting material for the Czech registration of a matrimonial event that occurred in Australia is the Australian matrimonial document (birth certificate). The applicant for registration of the matrimonial event should be a Czech citizen, as during the application process, you will need to sign and submit a declaration of citizenship.

The Australian birth certificate must be certified by an apostille (i.e. a special certification issued by the Australian Department of Foreign Affairs - DFAT). The birth certificate, including the apostille, must then be officially translated into Czech. Translations made by the applicant cannot be accepted. A translator listed at our embassy website can be contacted to make the translation.

Birth registration and issuance of a Czech birth certificate

To establish the Czech citizenship of a child, registration of the child's birth and subsequent issuance of a Czech birth certificate, it is essential to know, whether the child was born in marriage. If the child wasn‘t born in marriage, another important factor is whether the child's mother has Czech citizenship or what citizenship the mother of a child, whose father is a Czech citizen, has.

For the registration of the birth of a child born in Australia and the issuance of a Czech birth certificate, the following documents are generally required:

  1. Australian birth certificate of the child with an apostille; and
  2. a Czech translation of the Australian birth certificate including the apostille (as instructed above); and
  3. a valid Czech ID card or a valid passport of both parents; and
  4. birth certificate of the applicant or both parents of the child, if they are citizens of the Czech Republic or Slovakia (citizens of Australia or another country do not submit a birth certificate); and
  5. the Czech marriage certificate of the child's parents if the child was born in marriage (if you do not have a Czech marriage certificate, you must apply for one first - see below); and
  6. if the child has acquired another nationality, you must provide the relevant document proving this (e.g. a foreign passport). This also applies to the child's parents if they have also acquired another citizenship.

Furthermore, if the child wasn't born in marriage and the child's mother is not a Czech citizen (and the child's father is listed on the foreign birth certificate):

  • - the child's mother is a citizen of the EU, Switzerland or a State that is a contracting party to the Agreement on the European Economic Area (hereinafter referred to as the European Union), provide a completed and signed Record of Establishment of Paternity by Consenting Declaration of Parents
  • - the child's mother is not an EU citizen, the following documents must be completed and signed:

  1. record of the establishment of paternity by a declaration of consent of the parents; and
  2. a duly translated and certified (apostilled) confirmation of paternity by genetic test performed in an accredited laboratory. The test must be performed in the form of an expert, branch of genetics, performed by an expert or an expert institute registered in the list of experts or expert institutes maintained by the Ministry of Justice of the Czech Republic.

Should the parents request the registration of a female's surname in the male form (without -ova), it is mandatory to fill in the Birth record in the male form, at the time of the child's birth.

All documents must be submitted in the original. A copy is not sufficient. All documents other than the Australian birth certificate (or expert paternity opinion by genetic testing) will be returned to you immediately upon receipt of the application.

The presence of both parents is not necessary if the child is born in marriage (i.e. the parents have a Czech marriage certificate with an agreement on the child's surname) and the parent who is a Czech citizen appears at the embassy, presents the documents of the other parent and forms signed by him/her. The presence of both parents is necessary if they intend to choose a male form of the surname for their daughter, choose a second first name, or choose only two first names out of many, etc. The presence of the child is not required if the child is under 15 years of age.

Note: the applicant's permanent residence is usually the applicant's last address in the Czech Republic (or see the notice below). This applies unless and until the applicant cancels his/her permanent residence in the Czech Republic.

The processing times to issue a birth certificate and a certificate of citizenship of the Czech Republic may take 4-5 months. The Embassy has no control over the processing times, as the application is sent by our Embassy for processing to the Municipality of Prague 1 and then to the Special Registry Office in Brno. From Brno, the newly issued documents are sent, via the Ministry of Foreign Affairs, back to our office.

Please note:
After the birth of a child (of a citizen of the Czech Republic) abroad, the registry office issues a birth certificate and at the same time registers the birth data in the agency information system of population registration. The child is given a permanent residence address in the Czech Republic by law, in accordance with Section 10(3) of Act No. 133/2000 Coll., on population registration and birth numbers. The place of permanent residence of a citizen at the time of his or her birth is the place of permanent residence of the child's mother or adoptive mother.

If the place of permanent residence of the child cannot be determined according to the above, the place of permanent residence of the child is the seat of the Special Registry Office in Brno (Brno, Dominikánská 2).

Citizens born abroad, therefore, acquire a legally valid permanent residence in the Czech Republic based on the registration of their birth in the Special Registry. However, this does not apply only to newborns; permanent residence in the Czech Republic by birth is granted to all citizens who apply for registration of their birth in the Special Registry. Permanent residence in the Czech Republic may be terminated.

By registering permanent residence, an obligation to pay the municipal waste fee, among other things, applies. This obligation does not arise, for example, for citizens registered for permanent residence at the official address of the Special Registry Office in Brno
