Investigation in the situation in Ukraine commenced following the referral of States Parties to the Rome Statute indicating that crimes within the jurisdiction of the Court appear to have been committed. The referral was made on behalf of 39 States Parties to the Rome Statute, including the Czech Republic.
While Ukraine is not a State Party to the Rome Statute, it accepted jurisdiction of the Court pursuant to Article 12.3 with respect to war crimes and crimes against humanity committed in its territory since 21 November 2013. As such, the investigation will encompass acts committed by the Russian Federation since 24 February 2022.
